New housing decree 2026: risk management for large property owners in Vigo

· 6 min read

Large property owners in Vigo and Royal Decree-law 29/2026: portfolio reviews, contracts, arrears and management options to protect property assets.

For a large property owner or portfolio holder in Vigo, the priority following the new decree is to protect assets, retain oversight and make informed decisions. If you are concerned about arrears or difficulties recovering possession, start with each contract, actual use and supporting documents. Assets do not all carry the same risks, and renaming a contract does not guarantee a different legal regime.

Which housing decree are we referring to?

The source is Royal Decree-law 29/2026 of 6 October, adopting urgent measures to protect the social function of housing and expand affordable housing supply. The BOE lists publication on 7 October and entry into force on 8 October 2026. This guide was prepared on 20 October 2026. Before signing, check the current wording, parliamentary proceedings and official publication. The consolidated BOE text is provided for information.

What to review before renewal, rent updates or a change of model

  • Contracts and annexes: signing date, term, extensions, rent-update clauses and notices already sent.
  • Each home's situation: occupied, vacant or awaiting refurbishment. Units within one building may differ.
  • Actual use: a primary home, a documented temporary stay or an accommodation business. Do not select a contract solely by its length.
  • Rent and costs: collected income, utilities, maintenance, insurance and management fees. Separate gross income from net results.
  • Administrative requirements: check planning compatibility, regional rules and authorisations before changing use.

Arrears and recovery of possession: reviewing portfolio exposure

Concern about access to an asset calls for a case-specific review, not an assumption that evictions are universally prohibited. Prepare contracts, payment records, notices and relevant dates for a qualified legal professional. Management focuses on identifying, documenting and monitoring issues for each unit. We do not guarantee evictions, recovery timelines or rent collection: any action must follow the applicable legal procedure.

Does student or room-by-room letting avoid the obligations?

Do not assume so. Student status, a monthly contract or letting individual rooms does not establish an exception by itself. The actual purpose, evidence and applicable regime need legal review. A hotel, guest house or tourist apartment is not an automatic alternative for a residential home either: the proposed activity must independently meet its requirements.

A management solution for your Vigo portfolio

Rent it Properties offers a management approach for buildings and housing portfolios: asset-by-asset assessment, rent monitoring, maintenance and comparison of feasible operating models. We organise the position of each unit to help prioritise incidents, investment and decisions. Arrears, contract termination and recovery of possession require case-specific legal advice; management does not replace that review.
